FEES PAYABLE TO THE TUTOR
· Fees shall be calculated per hour of tutoring, dependant of key stage required to run the session, as stipulated below.
· All fees charged are inclusive of preparation time of the tutor.
· Fees may be adjusted from time to time and shall become effective after having given the student 14 days written notice.
1:1 KS2 = £20
Group KS2 = £10/pupil
1:1 KS3 = £25
Group KS3 = £15/pupil
1:1 KS4 = £30
Group KS4 = £20/pupil
1:1 KS5 = £35
Group KS5 = £25/pupil
PAYMENT
· Payment shall be made no later than stipulated by the invoice prepared by the tutor.
· Payment may also be made in advance.
· Payment may be accepted in many forms as stipulated by the invoice prepared by the tutor.
· If sessions are part of a block booking, payment will be accepted either as a whole block payment, or as individual sessions (please see “Schedule of Sessions” for more information about re-scheduling sessions in a block booking).
SCHEDULE OF SESSIONS
· Tutoring charged at the rate agreed per hour, shall commence immediately and thereafter on an ad hoc basis, as mutually agreed upon by tutor and student.
· No further tutoring sessions will be scheduled until outstanding balance, if applicable, is paid in full.
· If booking block sessions, an exception to the rule above will be made, providing each session is attended. If two or more sessions are missed or cancelled at late notice, consecutive bookings will be cancelled. A partial refund may be negotiated at the tutor’s discretion.
· Block bookings may be made up to one whole school term but no further.
LATE ARRIVAL AND CHANGE OF SCHEDULE
· Fees are calculated according to the scheduled time agreed upon by the tutor and student.
· No adjustment to fees shall be made for time due to late arrival by the student or by late cancelation of a session by the student.
· Any lost time due to the late arrival of the tutor shall be compensated by extending a lesson by mutual agreement and by such amount of time that was lost.
· The tutor agrees to wait 15 minutes from the time of the scheduled session for the student's arrival before considering that session cancelled without sufficient prior notice and therefore subject to full payment of the bill for the hour.
· Cancellations will be refunded up to 24 hours prior to the session starting.
· Any cancellation made after 24 hours prior to, but before the session starting, will not be refunded, and charged at full price for that session.
OBLIGATIONS OF THE TUTOR
· The tutor undertakes to do all preparation prior to lessons and to structure lessons in such a way as to optimize time for the benefit of the student.
· The tutor shall keep all information of the student confidential (as stated in the privacy notice page) and shall contact other parties involved in the education of the student only if given written permission by the student, and/or student's guardian, to do so.
· The tutor shall at no time be required or obliged to execute homework or assignment on behalf of the student.
KEEPING YOUR CHILD SAFE
· The tutor is dedicated to keeping your child safe, and despite not being in an educational institution, is well versed in the document “keeping children safe in education 2024” (https://assets.publishing.service.gov.uk/media/6650a1967b792ffff71a83e8/Keeping_children_safe_in_education_2024.pdf)
· In the instance a child discloses a safeguarding issue, the tutor will exercise their right to report the safeguarding issue to the relevant authorities, as deemed necessary by the tutor.
· The tutor will continue to undergo relevant safeguarding training to ensure that the safety of your child is paramount.
· Upon request, the tutor will disclose their DBS status as either a copy of their most recent DBS, or as their DBS update system number.
OBLIGATIONS OF THE STUDENT
· The student undertakes to assist the tutor in identifying problem areas in which the student needs specific tutoring.
· The student agrees to provide their own materials needed for each tutoring session.
· The student agrees that assignments, exercises, or homework form an integral part of tutoring and undertakes to complete such work in a timely manner.
NO WARRANTIES
· The tutor makes no promises or warranties with regards to a student's performance, as a result of any tutoring provided.
STATUS OF THE TUTOR
· It is expressly understood that the student retains the services of the tutor as an independent contractor (self-employed) and not as an employee.
· The tutor shall be responsible for his/her insurance and for all statutory declaration and contributions regarding income tax and national insurance contributions.
TERMINATION
· This tutoring contract may be terminated by either party at any time by giving the other party seven days prior written notice.
RELAXATION OF TERMS
· No relaxation, indulgence, waiver, or release by any party of any of the rights in terms of this agreement on one occasion shall prevent the subsequent enforcement of such rights and shall not be deemed to be a waiver of any subsequent breach of any of the terms.
WHOLE AGREEMENT
· This agreement constitutes the entire understanding between the parties regarding the subject matter thereof and the parties waive the right to rely on any alleged expressed or implied provision not contained herein.
· Any alteration to this agreement must be in writing and signed by both parties.
Where the student is under the age of 18, the parent/guardian must enter into a tutoring contract on behalf of the student and shall accept and agree to all the terms and conditions contained herein on behalf of the student.
